Terms and Conditions

Please read the entire terms and conditions of use carefully before you use Ship2Africa.com. if you do not agree to all these terms and conditions, you may not use the site. By using the site, you are deemed to have accepted these terms and conditions.

1 General Information

1.1 Agreement

This User Agreement  (“Agreement“ is a legal binding agreement between you (referred to as “you” or “Client” or "Customer" and Ship2Africa (“Ship2Africa” or "we" or “us“. This Agreement governs your use of the Ship2Africa website (referred to in this Agreement as “Ship2Africa” or “Site" or "Website"). All services provided by Ship2Africa are described in Ship2Africa and are collectively referred to in this Agreement as “Services.” As a condition of your use of this Site, you represent and warrant to Ship2Africa that you will not use this Site or the Services for any purpose that is unlawful, immoral or prohibited by these terms, conditions and notices.

This Agreement supplements the terms and conditions of the Services described in the Site. By accessing the Site or opening a new account with Ship2Africa, you agree to be bound by and hereby become a party to all the terms of this Agreement.

We can amend this Agreement by posting the amended terms on Ship2Africa, which take effect when we post them. By continuing to access or use Ship2Africa after any such amendment, you agree to be bound by the terms of the amended Agreement. Otherwise, this Agreement may be amended only by a writing physically signed by us.

1.2 Introduction

Ship2Africa offers several services for package and mail forwarding to Africa, including parcel reception services, warehousing, destroying services, scanning services, shopping assistance, mail forwarding and destination services. The aim of which it is to bring global markets closer to the Customer in order to profit from interesting offers in countries without leaving domicile or office.

2 Access and Customer Account

2.1 Access and identification

Before client uses the Services, he must open a Ship2Africa Customer Account by completing the Ship2Africa Registration form with true, accurate, current and complete information about himself. Client guarantees that all data matches reality. If any information provided is untrue, inaccurate, not current or incomplete, then Ship2Africa has the right to suspend or terminate client's access and refuse all use of the Site and the Services.

Client commits himself to inform Ship2Africa of any changes to his personal registration data. By signing up client must agree to our General Terms and Conditions. Once the Client is admitted to our site, a personal account and ID Number for mail reception will be allocated to him. To access his personal account, the Client chooses a password which is personal and confidential. The Client bears the entire liability for the use of the personal account’s data and the identification elements login information and password, which are strictly confidential and incommunicable. He commits himself to not sell or communicate them to third parties. In case of any loss, fraudulent use or theft of data he must notify Ship2Africa without delay. In such case the personal account will be blocked

2.2 Registration fees

When registering a onetime registration fee and a annual fee (according to pricing section will apply to each new customer. The fee can be paid by PayPal, Credit card or cash in one of our local agent's offices. Registration and Annual fees are not being refunded to client even in case of termination of contract.

2.3 Annual fees

The annual fees for the first year are paid along with the registration fees whereas the annual fees for the following years are being deducted from customers funds automatically. In case there are no funds available in customers account to cover the annual fees, account will show a negative balance. Consequently, no payable services can be used by the client unless he recharges funds.

2.4 Funds

All financial transactions between Ship2Africa and the client are managed through the funds account in the customer section of our site. Customer can add money to the funds account by PayPal, Credit card or local agents cash payment. The actual fund balance as well as all the payments made to funds and all the charges can be seen in the "Funds" Section on our site. Please note that funds are only refunded to client in case client wishes to terminate his contract with ship2Africa. Any banking charges to refund money are deducted from clients fund in such a case. In case Ship2Africa closes an account because of inappropriate or fraudulent use of our Site or services, no money will be refunded unless proofs from legal authorities are supplied.

2.5 Respect of personal data and correspondence

Personal information related to the Client and confidential data provided by the Client or resulting from the mail delivered by Ship2Africa shall remain confidential. Furthermore, the Client allows Ship2Africa to safeguard personal information such as addresses, credit card information, bank account or PayPal account within the limits required for the exercise of its activity.

Ship2Africa staff is advised to treat Client’s data, instructions, messages, phone calls, fax and electronic mails respecting strictest confidentiality guidelines complying with laws of data protection and mail secrecy and to not disclose any information relating to the Client, to any third party. Excluded from this rule are except necessary information like addresses and content of parcels passed on to freight forwarders, PayPal or our online payment system.

2.6 Website contents and intellectual property

Our Website content is protected by copyright and shall not be copied or used for other purposes. Client is not allowed to publish any information from our webpage or link websites to our site without approval. We respect the intellectual property of third parties. All trademarks and brands mentioned on this website are property of their owners.

2.7) Termination of account

You may terminate your account with Ship2africa at any time as long as you do not have any parcels in our custody or in transit to your destination. When terminating an account you confirm and agree that you have received all your parcels and no further mail is being sent to ship2Africa.

Annual fees and registration fees may not be refunded in such a case.

All data related to your account will be deleted in such a case. Please refer to our privacy policy for more details.

2.8)  No License

Except as expressly provided in this Agreement, nothing contained in this Agreement or on the Site shall be construed as conferring any other license or right, expressly, by implication, by estoppels or otherwise, with respect to any of Ship2Africa’s content or any third party’s content. Any rights not expressly granted herein are reserved.

You agree not to use the Site or the Services to:

 Harm, compete or threaten Ship2Africa or its users in any way

Disseminate or transmit any content that infringes or violates any party’s copyright, trademark, trade secret, patent or other rights.

Order any by legally prohibited articles using our address.

Violate any law (whether local, state, national, or international, whether or not intentionally;

Forge Internet protocol headers or otherwise manipulate identifying information in order to disguise your identity;

Provide fraudulent, inaccurate, or incomplete information to Ship2Africa or any shipping service or government agency;

Use Ship2Africa address or address of its agent's for commercial or residential related purposes such as opening a company or a bank account.

Interfere with or disrupt the Services, the Site, or servers or networks connected to the Site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site;

Collect or store personal data about other users;

Engage in any activities that would violate the personal privacy rights of others, including but not limited to, collecting and distributing information about Internet users without their permission, except as permitted by applicable law;

Post or cause to be uploaded to Ship2Africa’s computer servers or network any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

2.9) Fraud Prevention

Ship2Africa is continually working to prevent payment fraud. Three of the most important fraud prevention measures that we use are passwords, account verification, and spending limits. Also we require that all items you send to us are fully paid to the seller.

3) Ship2Africa Services

3.1) Shipping calculator

In order to give client an idea about the delivery costs of a parcel to his destination country client may use our shipping calculator. Prices indicated in the shipping calculator do not represent an official and legally binding offer. Rather are they estimates based on the information provided by customer. Prices indicated in the shipping calculator include only shipping costs. Ship2Africa's other service charges and duties and taxes in the destination country are not included in the price.

The final and effective shipping costs can only be evaluated once the shipment is ready for dispatch, actual weight, dimension, current exchange and transport rates  are known. 

Transit time indicated in the shipping calculator refer to the time when parcel leaves warehouse until arrival at final destination. The time between the transport order and the date when parcel leaves our warehouse are not included in transit time. This may vary depending on the mode of transport, volume, origin and destination.

3.2) Shopping

3.2.1) Buying articles on your own

Client is allowed to buy items from any merchant and send it to our warehouse. Excluded are items mentioned in Section 3.3.3 of this document or items which are prohibited by law. Client is not limited to the web shop partners indicated in our shopping assistance section. We however, recommend to use only trusted shops for online shopping. Client will always be deemed as the owner of the item ordered. Client has to pay for article and all related costs to ship it to Ship2Africa warehouse. Ship2Africa does not accept cash on delivery and will return parcels shall such a case arise.

Each package that you send to Ship2Africa must be addressed correctly. Your correct name and Ship2Africa Personal Identification number must be mentioned on each package.

Ship2Africa does not need to be notified in case you buy an item.

If a package arrives with an incorrect or incomplete address (for example missing personal Identification number or an unknown or misspelled name, Ship2Africa will try to determine whom it belongs to. If Ship2Africa is able to determine the owner of the package, it will be registered with the correct Customer Account. If the owner cannot be determined within 30 days of the package's arrival, the package will be liquidated.

In case of repeatedly received parcels without correct labeling Ship2Africa is reserving the right to deduct a service charge of 5 USD from customers funds.

3.2.2) Shopping assistance purchases items for you

If client wants Ship2Africa to purchase a product for him he can fill in a shopping assistance request on our site. Ship2Africa is purchasing articles from trusted web shops indicated on our site only.
Client has to fill in the fields for Product URL, Product name, color, size, quantity, product price and deadline .
Shipping costs from web shop to warehouse should be included in the price if possible. If you are unsure if shipping costs apply and how high they are check the box: ? I authorize Ship2Africa to modify product price in case shipping costs from web shop to warehouse apply. Shopping assistance operator will then adapt the product price according to shipping rates of the web shop.
Our Basic charge and Commission percent will be shown automatically when entering the above values. By clicking "submit" the purchasing contract between client and Ship2Africa becomes effective and the total amount of the wished item will be charged to customers funds.  All details regarding the shopping assistance order are displayed in the customer's account / shopping assistance section.
All Articles purchased through the shopping assistance are invoiced as gross values including local VAT. Note that Ship2Africa cannot reclaim VAT for its customers.
In case of price difference between the shopping assistance order and the real value in the web shop we will either refund or deduct the amount from clients funds.  For any shopping assistance order Ship2Africa will issue an invoice to the client, so that ownership of the product is awarded to client.
Ship2Africa gives no guarantees for the purchased products, since the purchasing transaction is seen as a transaction between the customer and the web shop and ship2Africa is acting only as a intermediary. 

 
3.3)  Reception of Items

Ship2Africa is entitled to accept shipments/ mail and sign delivery notes on behalf of the Client. According to the size of the shipment a reception fee will be deducted from customers funds, please refer to prices in the pricing section of our site. In case of insufficient money a negative balance in funds will appear.

At every reception customer is notified by email immediately, furthermore new parcel will be shown in his customer account / my parcels section.

3.3.1) Addresses

Each package that you send to Ship2Africa must be addressed correctly. Your correct name and Ship2Africa Personal Identification number must be mentioned on each package.

3.3.2) Part deliveries

Received Parcels will be forwarded to you in its original packaging (as received. Some online stores may ship a single order in part deliveries. In such a case, Ship2 Africa will register each individual package as a new reception and you will be charged for each reception.

3.3.3) Contents of the shipments / Forbidden items

The Client commits himself  not to order, to solicit or to be recipient of any Item non-compliant to the Ship2Africa policy or legal requirements, and notably the following items:

alive or dead animals, cash, bonds, negotiable papers, precious metals, arms and munitions, high value objects (for ex. Art, antiquities, fur, dangerous or high risk shipments, food or perishables, medicines, narcotics, ionizing materials, alcohol, tobacco, such as  every object which trading, detention or transport is illegal or contrary to morality or to public order in the expedition country, in the destination country  or the transit country or for which the documents requested by the Customs or police regulation are missing. The present list is not exhaustive.

Ship2Africa is entitled to but is not obliged, to control the content and the condition of shipment by every resources (including scanners, x-rays, drug sniffer dogs etc. and where necessary, in cooperation with authorities.

Customer is responsible and has to indemnify Ship2Africa of all costs and fines incurring if a shipment violates the above regulations. We may close clients account for ordering above items to our warehouses or shipping them with Ship2Africa.

Customers responsibility to comply with legal and transport related laws

The Client must verify compliance of his shipment and its documents with applicable law in the country of dispatch and the country of destination.

3.3.4) Oversize Packages

Oversize packages are any package over the size or weight limit mentioned in the Service / Receiving section of our site will need to be divided, reduced, trashed or returned to the sender.

3.3.5) Reception of defective items

If ship2Africa realizes that article has arrived damaged then we will inform you and parcel will be returned to the sender

3.4) Warehousing

Ship2Africa Stores packages free of charge for a period of 30 days from the date of arrival to warehouse. After 14 days customer may leave his package in our stock against a warehousing fee / kg / day indicated in our site. Please refer to Warehousing fees. Maximum storage duration is 90 days. Those fees are deducted from funds at a daily base

3.5) Scanning Service

Clients who choose this service specifically authorize Ship2Africa to open letters, registered letters and urgent documents, to scan them and send them as a PDF format to customer's email. Scanning charges will be deducted from your funds according to our pricing section on ship2Africa.

3.6) Commercial invoice / preparation of shipping documentation

Client must fill in a commercial invoice for all parcels not being accompanied by an invoice from the vendor as well as for consolidated shipments (more than 1 parcel in one shipment

If a shipment necessitates payment of custom duties, the Client will be responsible for handing over the appropriate and complete documentation. 
 

3.7) Customs Clearance / Export from Warehousing country

Ship2Africa or its appointed transporter will organize the necessary paperwork for customs clearance. Those documents are based on the commercial invoice furnished by the client. Ship2Africa is not liable for the correctness of the information in the commercial invoice.

Any documentation requested by customs must be delivered from the customer.

Except for contrary instruction and as long as necessary, the Client accepts that the transporter or carrier appointed by Ship2Africa will, in this case, act  in name and on behalf of  the Client for custom clearance

In principle the transporter will not take any liability in relation with the customs clearance. In case taxation applies, taxes, penalties, storage costs or other costs resulting from customs authorities actions or from the lack of proper documentation or requested permit within the framework of transport of shipments, all costs have to be paid by the client. 

3.8) Customs Clearance / Import at final destination

Except for contrary instruction and as long as necessary, the Client accepts that the agent appointed by Ship2Africa will, in this case, act  in name and on behalf of  the Client for custom clearance

Ship2Africa or its appointed agent will organize customs clearance and delivery to local warehouse of the agent. Any documentation requested by customs must be delivered from the customer.

If customs authorities hold back any shipment, client must deal directly with authorities to clear his shipment and pay any related costs due to the import of his shipment.

In principle the agent will not take any liability in relation with the customs clearance. In case taxation applies, taxes, penalties, storage costs or other costs resulting from customs authorities actions or from the lack of proper documentation or requested permit within the framework of transport of shipments, all costs have to be paid by the client.

Ship2Africas rates and services do never include customs duties or any related costs related to the import of goods to final destination.

3.9) Shipping

3.9.1) Shipping order

Once customer has received one or several packages at the warehouse he can send or consolidate them into one shipment within the "my parcel" section of our site.

Customer is then transferred to a site where he can fill in a commercial invoice. Client must ensure that information on the commercial invoice is consistent and accurate. Items must be described as detailed as possible. The value indicated in the commercial invoice is that value which will be used by tax / customs authority to calculate import duties / taxes. Be aware that customs is allowed to inspect parcels at any time. If your documents include incorrect product descriptions or product values parcels can be retained by customs. In addition, there may be additional cost due to fines.

Once commercial invoice section is filled in completely, customer will be given effective transport rates. He will be shown different rates of parcel services such as TNT, UPS or DHL as well as Ship2Africa rates. Customer can choose Air, Sea or Road freight. When choosing the rate final price will be indicated.

When pressing "Send Request"  the transport order is officially given to Ship2Africa and the final amount will be deducted from your funds.

In order to ship items client must have sufficient funds in his account. Please refer to section 2.4 of this document on how to add funds.

Ship2Africa ships only by the shipping methods offered in the shipping calculator shown on Ship2Africa.com. Ship2Africa is not responsible for the actual shipping service when choosing a third logistic service provider like DHL, UPS or TNT.

3.9.2)  Damages/Loss during transport

Ship2Africa shipments are insured for loss and damage to a value up to 500 USD (item value according to the Warsaw Conversation. Other types of loss or damages such as, but not limited to, lost profits, income, interest or future business are excluded. Damages clearly caused by third parties are excluded from this insurance.

An additional, payable insurance can be obtained for values over 500 USD if client wishes so.

Certain goods (sensitive or breakable items may have restricted liability due to our dependence on transport companies. Every request for additional insurance will be carefully examined therefore.

Second/hand goods are excluded from insurance.

Ship2Africa are not liable for any damages caused by force majeure, influences of nature or by natural variation of the transportable goods, unless a culpable causation of the damage through us can be determined (such as a wrong packaging or faulty addressing. In addition, we are not liable for the damage or deletion of electronic or photographic images, data or recordings due to electrical or magnetic noise.

 

3.10) Pick-up at local agent

As soon as parcel / mail arrives at local agent's warehouse, client will get an email notification and parcel needs to be picked up at the agents warehouse. At pick up client is signing a document to confirm delivery to him. There is a free storage time of 7 days for parcels up to 5 kg. All other items, heavier than 5 kg are being stored for free for a maximum period of 30 days. If you wish to store items beyond this period, local agent needs to be contacted.

 

3.11) Wrong allocated parcels

If a package has been received and client did not order it, then Ship2Africa agent must be notified immediately.

4.) Liability

Without no prejudice as to strict controls, Ship2Africa declines any liability for the content of external links. Merchant website operators are fully liable for the content of external links. 
Ship2Africa declines any liability for any potential damages resulting from inexact or missing data in this online offer. 
Ship2Africa declines any liability for the purchases, availability, shipment, reservation, and invoices done by merchant website referenced by our shopping assistance
The information diffused on the “shopping assistance” web site is based on sources considered as honest.

Ship2Africa does not warrant that this site, application, its servers or e-mail sent from Ship2Africa are free of viruses or other harmful components. Ship2Africa will not be liable for any damages of any kind arising from the use of this site and/or application, including, but not limited to, direct, indirect, incidental, punitive and consequential damages. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you and you might have additional rights.

All right, title, and interest in the web site and services provided therein, including, but not limited to, all associated market data and information is owned by Ship2Africa, and you acquire no interest therein. All rights reserved. Any unauthorized use or any reproduction, modification, or distribution of materials is strictly prohibited. All other trademarks or trade dress not owned by Ship2Africa that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Ship2Africa.

The Ship2Africa Privacy Policy governs the use of information collected from or provided by you at the Web Site.
The links to other websites will let you leave Ship2Africa site. The linked sites are not under the control of Ship2Africa and Ship2Africa is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. Ship2Africa is providing these links to you only as a convenience and the inclusion of any link does not imply endorsement or any representation by Ship2Africa of the site. It is up to you to take precautions to ensure that whatever you select for your use is free of such items as viruses, bugs, problems or other limitations. 

You may close your account with or without cause at any time. Ship2Africa may terminate your use of the Service with or without cause at any time and effective immediately, at Ship2Africa's sole discretion, should your conduct fail to conform to the terms and conditions of these Terms of Service. Ship2Africa shall not be liable to you or any third party for termination of the Service or termination of your use of the Service. Should you object to any terms and conditions of the Terms of Service or any subsequent modifications Ship2Africa makes to the Terms of Service or become dissatisfied with the Service in any way, your only recourse is to immediately discontinue use of the Service and notify Ship2Africa of your termination and, at your discretion.

You agree to use the Web Site in strict compliance with all applicable laws, rulings and regulations and in a fashion that does not, in the sole judgment of Ship2Africa, negatively reflect on the goodwill or reputation of Ship2Africa and shall take no actions which would cause Ship2Africa to be in violation of any laws, rulings or regulations applicable to Ship2Africa.

Ship2Africa shall be excused from performance of its obligations, in whole or in part, under this Agreement if the failure or inability to perform is caused by reason of Force Majeure. "Force Majeure" as used herein means, fire, flood or other natural catastrophes, electric, communications or other utility outages, national emergencies, civil disturbances, insurrections, riots, wars (declared or undeclared, epidemics, strikes or labor disputes, actions or restrictions of an governmental authority, or causes not within the reasonable control of Ship2Africa.

You agree that Ship2Africa, in its sole discretion, may terminate or suspend Your use of the Web Site, the Ship2Africa Systems, Information, Services and Content at any time and for any or no reason in its sole discretion, even if access and use continues to be allowed to others. Upon such suspension or termination, you must immediately (a discontinue use of the Web Site, and (b destroy any copies you have made of any portion of the Content. Accessing the Web Site, the Ship2Africa Systems, Information or Services after such termination, suspension or discontinuation shall constitute an act of trespass. Further, you agree that Ship2Africa shall not be liable to you or any third party for any termination or suspension of your access to the Web Site, the Ship2Africa Systems, Information and/or the Services.

You may not assign these Terms of Use or any of your interests, rights or obligations under these Terms of Use. If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
